Description: On May 29, 2020, the plaintiffs, both New York State legislators, were participating in a protest at the Barclay's Center in Brooklyn. The peaceful protest was organized after the deaths of Breonna Taylor and George Floyd in May 2020. Plaintiffs identified themselves as lawmakers to police officials before and during the protests. Shortly before 8 AM, the defendant NYPD officers broadcast a message to the protesters, telling them to disperse, despite having no legal basis for this order. Plaintiffs attempted to comply with these commands, but the NYPD officers "kettled" them in place, leaving them with nowhere to go.
