Description: On December 11, 2014, Haytham Abdallah ("Plaintiff") was in a car with his two cousins Mr. Issam Hamadan and Ms. Manal Hamadam. Plaintiff was in the front passenger seat of his cousin, Issam Hamadan's uncle's car. The car was previously damaged in an unrelated event, and the license plate was visible and legible on the windshield. Mr. Hamadan exited the car to enter a store on 3rd avenue and to avoid receiving a citation, Plaintiff moved into the driver's seat, however, he never drove the car.
