Description: On July 1, 2022, Plaintiff Jose Alba was a clerk of a Manhattan convenience store who alleges to have been attacked with deadly force resulting in his own use of deadly force with the affirmative defense of self-defense. Plaintiff would then be arrested for his role in the events. Plaintiff claims unlawful search/seizure, false arrest, malicious prosecution, abuse of process, violation of equal protection under the constitution, and failure to intervene. Plaintiff also named District Attorney Alvin Bragg in his complaint for the decision to prosecute him.

Complaint
Description: On February 3, 2012, Plaintiff Andy Almanzar was at the subway stop on West 181st and Saint Nicholas Avenue when Defendant Officers William Garcia and Rudolph Rosado stopped Plaintiff without reasonable suspicion or probable cause. They proceeded to unlawfully search and frisk plaintiff. Defendant Officers then confiscated Plaintiff's pocketknife and arrested him. Defendant Officer Garcia completed a Stop and Frisk report which indicated there was not sufficient cause to stop and detain plaintiff and Defendant Sergeant Steven Silverstein signed off. Despite this, Plaintiff was issued a desk appearance ticket with false allegations that he possessed a "gravity knife."
