Description: On February 28, 2018, Defendant NYPD Officers Kyle Erickson and Elmer Pastran stopped Plaintiff’s vehicle while Plaintiff was driving in Richmond County, New York. The officers ordered Plaintiff and his passengers to exit the vehicle, then searched Plaintiff, his passengers, and the vehicle. The officers did not find any contraband in the vehicle. Defendant Erickson then allegedly planted a partially burning marijuana cigarette in Plaintiff’s vehicle. The officers then handcuffed and arrested Plaintiff. Description: On October 3, 2018, at approximately 3:00 p.m., plaintiff Lasou Kuyateh was falsely accused of felony firearm posession by NYPD officers Kyle Erickson, Elmer Pastran, and Frank Desiderato in Staten Island, New York. The officers claimed to have seen Kuyateh hand a firearm to an unidentified individual. Kuyateh was arrested, handcuffed tightly, and detained in a holding cell without being charged with any crime. As a result of the false arrest, Kuyateh suffered loss of liberty, emotional distress, and pain.
