Description: On August 31, 2013, the Plaintiff was in front of the 42nd Precinct when he saw Defendant Officer Paul Behan assaulting a detainee. When Plaintiff verbally objected, Defendant Officer Behan illegally and without provocation slammed Plaintiff against a car and tightly handcuffed him. Defendant Officer Behan took Plaintiff into a cell in the precinct, where Behan and Defendant Officers John Moise and Franny Nunez violently assaulted Plaintiff with punches and kicks. Defendant Officer Moise also struck Plaintiff on the head with a metal baton and choked him. Plaintiff was transported and treated at a hospital for his injuries including a perforated ear drum.
