Description: On May 23, 2016, Plaintiff Shyam Patel was with a friend in a Times Square seating area when he observed defendant police officers Hameed Armani, Peter Cybulski, Michael Farrar, Gabriel Mendez, Scott Carley, and former police officer Sherief Khamis walking in the area. Several minutes before, the same officers issued plaintiff a summons for, upon information and belief, windows excessively tinted. In an exercise of his First Amendment rights, plaintiff displayed his middle finger to defendant officer Armani. The defendants approached the plaintiff while plaintiff was video-recording on his cell phone.
