Description: On August 23, 2016, Plaintiff was involved in an altercation with the owner/employee of Fordham Fruit & Vegetable Store and called 911 for assistance. NYPD Officer Randy Bautista and Officer Conesto appeared and Plaintiff began explaining the altercation to the Officers. The officers refused to listen to Plaintiff and grabbed and arrested Plaintiff on alleged grounds of shoplifting, resulting in the handcuffs injuring Plaintiff's wrists. Description: On January 22, 2016, at approximately 6:25 PM, Plaintiff Yolanda Felipe was driving near 188th Street and Creston Avenue in Bronx County, New York, intending to visit her mother. After receiving permission from Officer Fanny Souffront to move a traffic barrier, she was confronted by Sergeant Alexis Fernandez, who refused to let her proceed. During the encounter, Sgt. Fernandez allegedly used a racial epithet, threatened to arrest her and her 13-year-old daughter, and ultimately ordered her arrest for charges including unlicensed operation of a vehicle and disorderly conduct.
