Description: On November 23, 2013 Plaintiff was preparing to eat dinner at the homeless shelter where he resided when an unknown individual approached, said "I should kick your ass," and proceeded to physically attack Plaintiff, severely bruising Plaintiff's ribs and scratching Plaintiff's face. There were approximately 20 - 30 witnesses and the attack was captured by surveillance cameras. Description: On May 25, 2014, Troy D. Gerard (plaintiff) was lawfully outside a subway station when he was assaulted and battered by Police Officer Christopher Villaneuva, Bekin Xhudo, John Does (defendants), knowingly, intentionally and willfully without probable cause or as the result of an appropriate arrest. The defendant was then maliciously prosecuted before charges were dropped. NYPD were negligent in their hiring, training and supervision.
