Description: On June 09, 2023, around 4:45 P.M., plaintiff Kenneth Garnes was standing on the corner of 40th Ave and 23rd St. in Long Island City, NY, when unmarked NYPD vehicles drove up to the corner and stopped. Several plain-clothes police officers exited the vehicles and patted down Plaintiff. Police Officers did not find any contraband and yet hand-cuffed Plaintiff. Plaintiff was driven around the neighborhood for about thirty minutes and then taken to 114th Precinct and then to a jail cell. Plaintiff remained in custody for about two days. The criminal charges against Plaintiff were dismissed and the case sealed.

Description: On September 20, 2022, plaintiff was stopped, detained, battered and assaulted, seized and searched as well as arrested by defendants. A few days before that, plaintiff was physically attacked by one of her children and then decided to leave that child at her parent's house for a few days to deescalate. Earlier on September 20, plaintiff had called 911 to make a complaint about her neighbor stealing her personal property and waited for police offers to arrive to take down the complaint.
