The child’s father came over, started an argument, and physically assaulted Plaintiff, including slamming her against a door and strangling her until she lost consciousness. Description: On January 17, 2019, around 3:15 P.M., plaintiff Melvin Fitzpartick and plaintiff Alphonso Lowe were in a store at 831 Rosedale Ave, Bronx, when they attempted to purchase food. Employees confronted and accused Plaitniff Fitzpatrick of taking food. Plaintiff Fitzpatrick was caused to suffered a cut to his lip as a result of a direct attack by the employees. Police Officers arrived and forcibly placed Plaintiffs arms behind their backs. Plaintiff Fitzpartick had his bag illegally searched. Plaintiff's were handcuffed for about 30 minutes, no items from the store were recovered.
