Description: On September 1, 2014, Plaintiff Pierce was at a Radio Shack attempting to buy an I-Phone case. After a store attendant noticed him waiting for an employee to undo the store fixture, she stated she would help him in a moment. Plaintiff Pierce waited and then noticed an I-Phone case not secured; he picked it up and was reading the back. A store employee then walked up to Plaintiff, addressed him in a rude tone, and accused him of attempting to steal the case. Plaintiff Pierce decided to take his business elsewhere to an AT&T store and was in the store for about twenty minutes.
