Complaint
Description: On September 19, 2013 PO Guillermo Monterrosa falsely accused Plaintiff of having committed a robbery approximately 2 weeks prior. Plaintiff was not identified by the victim of the robbery in a lineup but PO Monterrosa arrested Plaintiff regardless and transported him to the 33rd Precinct where a malicious prosecution was commenced against Plaintiff. In December of 2013 the robbery victim viewed a lineup of containing Plaintiff and failed to identify him. The criminal matter was terminated in favor of Plaintiff on January 14, 2014. Plaintiff suffered loss of liberty, emotional distress, humiliation, loss of enjoyment of life, fear, and intimidation as a result of this incident.
