Description: On or about June 19 2012 Plaintiffs David Darrell and Patrick Thornton were passengers in a vehicle legally parked in Queens, New York.Plaintiff Darrell just dropped money off to his girlfriend at Popeye's Restaurant and got back into the vehicle. Defendant officers pulled over plaintiff's vehicle as they were pulling away. Officers then proceeded to search each of the four passengers and the vehicle, asking "where's it at" to each passenger. The officers eventually found a small amount of marijuana and arrested all passengers.
