The acts were intentional, without justification or provocation and extreme as well as outragous. The conduct of Defendant Officer Thomas Denicker was extremely negligent The plaintiff has since suffered physical and emotional injury. The City of New York is directly liable for its role in enabling and perpetuating the misconduct through negligent hiring, training, and supervision of Defendant Officer Thomas Denicker. Description: Plaintiff was being arrested for misdemeanors. He informed Defendant Officers that he suffered from a diabetic ulcer on his foot and requested medical attention. He also requested that due to his size he be double cuffed rather than single cuffed. Defendant Officers refused and when Plaintiff then denied medical attention, Defendant Officers stripped Plaintiff naked assaulted, battered and dragged him through the precinct. Plaintiff sustained serious injuries.
