Description: On July 13, 2021, Plaintiffs were outside of a venue they had rented when they were approached by officers. While one of the Plaintiffs tried to explain that no one had called the police, the officers used excessive force and began to unlawfully arrest the Plaintiffs without cause. One Plaintiff was hit in the head by three separate officers to the point of losing consciousness and tased in the arm four times. He awoke at the precinct and was denied medical treatment. Another Plaintiff was thrown to the ground and an officer placed his knee on the Plaintiff's neck, was punched in the head, and was pepper sprayed. Description: On June 6, 2020, while plaintiff McCaffrey was biking in a peaceful protest, Officers Caravello, Shea, Ciappa, Yen, and Fuentes tackled McCaffrey and beat him. McCaffrey had not heard any order to disperse or other announcement from the officers. Officers held McCaffrey's hands behind his back, shoved him on the ground, put him in a headlock, punched him, slammed his head into the ground repeatedly, and put a knee on his back. McCaffrey did not resist or respond with force. Other officers observed the assault and failed to intervene. The officers then handcuffed and detained him without probable cause. McCaffrey was released with a summons for disorderly conduct, which was dismissed.
