Description: On May 14, 2013, Plaintiff was walking home from his work as a second grade school teacher, when he happened across a gathering of approximately 20–30 uniformed members of the NYPD in a public park. As he walked by, Plaintiff asked the officers what was going on. In response, PO John Doe 1 told Plaintiff to get off the sidewalk, prompting Plaintiff to suggest that it was, in fact, a public sidewalk. Plaintiff then turned to leave. As he walked away from the park, Plaintiff was struck from behind by PO Doe 1, resulting in his falling facedown in the street and losing consciousness, while PO Does 2–6 stood by and watched.
