Description: On July 26, 2023, Plaintiffs Marcel Rodriguez and Jose Colon were lawfully riding a moped in the Bronx, when they were pursued by unmarked vehicles without sirens or proper identification. One vehicle, without warning or lawful justification, deployed pepper spray directly into Plaintiff Rodriguez’s face, causing severe pain. The Plaintiffs, unaware the vehicles were occupied by law enforcement, attempted to escape. However, their path was blocked by a second vehicle, and Plaintiff Rodriguez crashed into the first vehicle while Colon's foot was run over by the second vehicle, causing injury.
