Description: On or about December 1, 2015 at approximately 9:30 p.m. Plaintiff was driving without any traffic violations when he was stopped by POs Louis Depergola and John Doe. POs ordered Plaintiff to exit his car and arrested him when he did so. At no time was Plaintiff in possession of or had custody of anything illegal, including marijuana. Plaintiff was brought to a precinct where he was strip searched and kept in a holding cell with other males for several hours. Plaintiff was charged with marijuana offenses; these charges were ultimately dismissed. The incident caused Plaintiff severe emotional distress.

Description: On or about May 7, 2014 Plaintiff was driving when he was stopped by POs Depergol and John Doe. POs ordered Plaintiff to exit the car and handcuffed him, despite the fact that Plaintiff had not engaged in any unlawful or illegal behavior. Plaintiff was transported to the 44th Precinct where he remained in a cell for several hours. POs verbally abused Plaintiff while he was in their custody. Plaintiff was charged with disorderly conduct, which was ultimately dismissed on September 22, 2014. Plaintiff was traumatized, fears for his physical safety, has been unable to sleep, and was forced to miss multiple days of work as a result of this incident.
