Description: On May 7, 2013, Plaintiff was arrested by POs Daniel Baca and Arthur Smith despite their having no warrant or reason to do so—Plaintiff had not and was not engaged in any criminal activity. PO Baca seized and searched Plaintiff, pulling Plaintiff's shorts and underwear down, exposing and touching his genitals in front of 25 onlookers. After completing their search, the POs handcuffed Plaintiff and placed him in the rear of a police van, where he was kept for several hours while the POs arrested other individuals and placed them in the rear of the van. Plaintiff was then imprisoned in the 44th Precinct, followed by Bronx Central Booking.

Description: On June 3 or June 4, 2013, near the vicinity of Morris Avenue and East 162nd St in the Bronx, Plaintiff was a passenger in a motor vehicle that was pulled over by undercover police officers, without probable cause. Plaintiff was directed to remain silent and exit the vehicle as Defendant Officers subjected Plaintiff to search of his person and an illegal search of the vehicle, where they retrieved a bag containing medication from the back seat which was sealed and marked as being from a local pharmacy, indicating the patient’s name. Plaintiff was arrested and charged with illegal possession of narcotics and the charges were later dismissed in Criminal Court.
