Toshia spoke with Badillo, who refused to give information she requested, saying “I’m not going to do what you want me to do;” and “Not on your time.” An ambulance was slowly coming down the street. The officer ordered Toshia to the sidewalk, to allow the ambulance to pass. Despite not blocking the roadway, Toshia was arrested. Description: The plaintiff retrieved his uncle's prescription pain medicine and cashed a check for him on the day of the incident. Then he met his uncle in the lobby of his uncle's residence and when he went to hand him the pills and cash the defendant officers, who likely followed the plaintiff, stopped him and pinned him to the ground giving the plaintiff no moment to explain. The defendant officers hit the plaintiff and then tased him. The plaintiff was transported to the hospital followed by the 26th Precinct.
