Description: On or about August 31, 2018, and extending into the early morning of September 1, 2018, members of the NYPD, led by Sergeant Alan Chau, arrived at a Pan Yard event held by the Heart of Steel Band in Brooklyn, New York. The plaintiffs, including Michael Demas, Catherine Nunes, Gwynn Glasgow, and others, were present at this event, which was organized as part of the J'Ouvert celebrations. Despite the event being a free community gathering with no profit or sale of alcohol, Sergeant Chau instructed officers, including Officers Fernandez and Vanbrakle, to arrest all plaintiffs, accusing them of operating an unlicensed bottle club under ABC law 64-b. Description: On September 4, 2017, NYPD police officer Ricardo Martinez unlawfully stopped and frisked Plaintiff who had not committed or attempted to commit any illegal act. Defendant handcuffed Plaintiff using excessive force, and filed an accusatory criminal complaint against Plaintiff without material evidence nor probable cause. Plaintiff's prosecution was dismissed in March 20, 2018. As a result of this false arrest and imprisonment, Plaintiff suffered physical injuries and emotional distress.
