Description: On May 27, 2008 at approximately 7:50pm, witnesses saw two boxes of shoes fall from an industrial warehouse roof and a man fleeing the scene. They called 911 and reported the events to NYPD Officers Messa and Assencao. The Officers proceeded to arrest Mr. Isaac, a nearby pedestrian who did not fit the physical description provided (apart from being a black male), and who was walking in the opposite direction that the man had fled. Officer Assencao fabricated an account to the ADA that he had personally observed Mr. Isaac holding the boxes, that the witnesses had directly pointed out Mr. Isaac, and other false details to support the arrest.
