Description: The plaintiff was a guest at his friend's residence when the defendant officers forced entry into the apartment, handcuffed the plaintiff, and searched the apartment. The defendant officers allegedly found illegal drugs and a firearm, but the plaintiff states these allegations were false. The plaintiff was charged with Criminal Possession of a Controlled Substance, Burglary, Criminal Possession of a Weapon, Possession of Pistol and Ammunition. As a result of violating parole, the plaintiff spent many months in jail before these charges were dismissed.

Description: Officers Nigro, Pichardo, and John/Jane Doe 1-12 responded to a radio run for gunshots fired inside the location of 2249 Stillwell Avenue, which was a multi-apartment dwelling. Plaintiff's 1-3 were in a friend's apartment with approximately 10 other people attending a party. Officers arrived at the apartment and began kicking the door and within minutes of entering, all party goers (who were in the living room) were handcuffed and laying face down on the floor. John/Jane Doe Officers 1-12 searched the rest of the apartment including bedrooms and bathroom. They were taken to PSA1 that night and central booking the next day.
