Defendants falsely concluded that the child died of Shaken Baby Syndrome and charged both Plaintiff and her husband with Manslaughter in the First Degree and Endangering the Welfare of a Child. Description: On or about February 15, 2012, Defendant Smith reported to Defendant Pough that he had overheard that Plaintiff had inappropriately touched several students at P.S. 52. In fact, Defendant Smith had not overheard such a statement and his false allegation was likely driven by animus. Defendant Smith coerced students into making false allegations against Plaintiff through a group discussion and effectively convinced 9 students to come forward with false statements.
