Complaint
Description: On August 30, 2021, plaintiff was lawfully present at the 115th Precinct stationhouse, Queens, NY, at which time defendants searched, handcuffed, and arrested plaintiff. After plaintiff was detained for 24 hours, defendants issued plaintiff a DAT that charged plaintiff with making false statements to officers on August 21, 2021 and released plaintiff from custody. Defendants provided the Queens DA with false information about the evidence and their basis for arresting plaintiff. On September 19, 2021, Plaintiff appeared in Queens Criminal Court pursuant to the DAT defendants issued, at which time plaintiff was advised the DA declined to prosecute him.

Complaint
Description: On March 4, 2022, Plaintiff was out celebrating a friends birthday at a house on 7th street in West Babylon, New York. When he left the following early morning, he was intoxicated, and realized he needed to return an item to the house. Plaintiff mistakenly approached officer Deotto's nearby home on 5th avenue instead of his friend's. Plaintiff attempted to open the front door, and officer Deotto shot him in the face at close range, striking through his right eye. Plaintiff was falsely arrested and detained, yet no charges were posed against him.

Plaintiff was taken to the 103rd Precinct and charged with Grand Larceny in the Fourth Degree, Endangering the Welfare of a Child, and Resisting Arrest. All charged were later dismissed.
