Complaint
Description: On February 16, 2011, Plaintiff was lawfully sleeping inside of his home when Defendant NYPD officers unlawfully entered Plaintiff's apartment. Upon unlawfully entering the apartment, the officers pointed guns at Plaintiff and his family and yelled at them to get onto the floor. The officers proceeded to handcuff Plaintiff and his family. At no time were any offending objects found on Plaintiff or in his apartment. Nevertheless, Plaintiff was arrested without legal justification or probable cause. On February 18, 2011, Plaintiff was released from custody without being charged because the DA's office declined to prosecute Plaintiff.
