Description: On August 28, 2011, Plaintiffs Echevarria and Martin were cleaning water from their apartment after Hurricane Irene. NYPD officers knocked and demanded entry. When Plaintiff Echevarria demurred, the officers grabbed him through the partially opened door. There they slammed Plaintiff Echevarria against a wall and cuffed him. When Plaintiff Martin asked what was going on she was told there were complaints about Plaintiff’s throwing garbage out of the windows, despite Plaintiff Martin showing the bags being assembled to take garbage out. The officers then conducted an illegal, warrantless search of the apartment. When Plaintiff Martin objected to their illegal conduct, Defendant Officer Mack ordered Defendan...
