Description: On March 30, 2018, Plaintiff Frankie Breton was approached by Defendant officers Elvin Pichardo and Valdrin Nikqi, who attempted to hand Plaintiff a plastic tube that contained marijuana. Plaintiff declined to accept the plastic tube, which fell to the ground, spilling marijuana onto the sidewalk. Plaintiff was physically seized by Defendants Pichardo and Nikqi without probable cause or reasonable suspicion. Plaintiff was placed under arrest, handcuffed, led to the unmarked car and brought to the 46th Precinct in the Bronx.
