Description: On or about December 6, 2011 PO Ivan Rodriguez, Det. Shannon Brooks, Det. Jorge Tobon, Det. Angus Mackenze, and PO Winston Favis forcibly entered Plaintiff's residence by breaking down the door with a battering ram. POs had no warrant to search or arrest, or other legal justification. Plaintiff and other occupants were falsely arrested. POs' stated reason for breaking into the apartment was the smell of marijuana smoke in the hallway. Description: On May 25, 2011, Plaintiff was in the hallway of his apartment building when he was grabbed by Defendant Detective Shannon Brooks and other NYPD Police . He was immediately handcuffed and searched. At no time did Plaintiff violate any law, nor did Defendant police officers have an objective factual basis to believe that Plaintiff violated the law in any way. Nevertheless, Plaintiff was falsely arrested and transported to the police precinct for arrest processing. In a holding cell at the precinct, Plaintiff was unlawfully strip searched without reasonable suspicion or probable cause. A criminal proceeding was commenced against Plaintiff but on September 26, 2011, all charges against Plaintiff were dismissed.
