Description: On September 11, 2020 Plaintiff was in the vicinity of Gerard Avenue and East 157th Street in the Bronx, when Defendant Officers approached Plaintiff for no reason and stopped, searched, and detained him in an aggressive and excessive manner. Plaintiff was falsely arrested, remained incarcerated for over 24 hours, and was required to make numerous court appearances over an extended period of time until all charges against him were dismissed.

Description: On August 12, 2020, defendants, including Modica, approached and arrested plaintiff without just reasons. Plaintiff had multiple assaults and batteries, committed to his person, by defendants, including Modica. Plaintiff was rear handcuffed by defendants, including Modica, and placed in a NYPD vehicle and transported to 44th NYPD precinct. Upon arrived, plaintiff was searched, questioned, photographed and fingerprinted by or at the direction of defendants, including Modica. Defendants provided false information in order to initiate a criminal prosecution against plaintiff. All charges against plaintiff were unconditionally dismissed.

Description: On September 3, 2019, plaintiffs were lawfully in the vicinity of 1454 Grand Concourse, Bronx, when defendant police officers, without any probable cause or legal justification, approached plaintiffs and summarily stopped, searched, grabbed, assaulted, battered, and detained them with excessive force. Defendants then proceeded to handcuff and arrest plaintiffs. While in custody, plaintiffs were strip-searched, and during arraignment they were falsely prosecuted with committing a crime. All charges made against plaintiffs were eventually terminated in their favor. As a result of defendants' actions, plaintiffs sustained severe physical snd emotional injuries.

Description: On November 16, 2019, around 9:30 PM, Plaintiff Alexandr Velazquez was near East 170th Street and College Avenue, Bronx, exited his friend's building on 170th Street and was grabbed by Defendant Officers Jospeph Modica, Andrew Alvarado and John Does 1-10, and Lieutenant Steven Degree, for no reason.
