Description: On October 6, 2022, while Plaintiff was in his car, he was approached by Defendant Officers Urgiles, Garcia, and Doe, who grabbed Plaintiff, pulled him out of his vehicle, and then proceeded to throw Plaintiff to the ground, where they kicked, punched, and stomped him to the face and body. Defendant Officers then forcefully placed Plaintiff in handcuffs. After receiving medical treatment for his injuries, Defendants transported Plaintiff to Bronx County Central Booking, wherein he remained until his release on October 7, 2022.

Defendants, three (3) NYPD Officers that include Officer Jose Rosa (Shield No.10342), summarily stopped, frisked, searched, grabbed, assaulted, battered, and detained him in an aggressive and excessive manner—absent an arrest warrant, probable cause, reasonable cause or any legal justification. Specifically, Plaintiff was subjected to a strip search by Defendants. Following his arrest, Plaintiff remained incarcerated for over 24 hours and was required to make numerous court appearances over an extended period of time until all charges against him were terminated favorably.
