Description: On October 22, 2013, Plaintiff attended his friend’s baby shower on E. 6th Street, Manhattan, NY. Plaintiff and four other individuals drove in a van back home to the Bronx. At E. 212th Street and White Plains Road, in the Bronx, the van was stopped by a NYPD cruiser. Officers ordered the occupants to exit the vehicle, and the occupants immediately complied. Plaintiff and the other occupants were patted down and searched, but no contraband was found. Plaintiff had to urinate, informed the officers, and waited an hour, before saying he had to go, and when he attempted to use a local restaurant bathroom, got tackled, handcuffed and ended up soiling himself.
