Description: On or about January 13, 2017, plaintiff Richler Morette was a passenger in a vehicle driven by Gedeon Gerderson near the southwest corner of Canal Street and Broadway in New York City. The vehicle was carjacked by an armed individual, who compelled Gerderson to drive for about two blocks before stopping. The carjacker fled, leaving a gun in the vehicle. The police, including Officer Francis Ford, arrived and pursued the gunman but failed to apprehend him. Instead, Officer Ford and others arrested Gerderson and Morette without probable cause. Description: On or about December 4, 2016 Plaintiff was peacefully protesting when Sgt. Rodriguez, POs Ford, Moyles, and John Does wrongfully and excessively detained, arrested, frisked, searched, assaulted, touched, battered, and verbally abused Plaintiff without legal justification. Plaintiff was taken to a police precinct or other holding area and thereafter maliciously prosecuted on a false charge of harassment. The District Attorney ultimately declined to prosecute Plaintiff. Plaintiff suffered severe and permanent injuries of a physical and psychological nature as a result of this incident.
