Even though Mr. Allen and his wife peacefully protested and committed no crime or offense, NYPD police officers assaulted Mr. Allen, arrested him, placed Mr. Allen in excessively tight handcuffs for an extended period, and held him in custody much longer than necessary to process his arrest and under dangerous and unsafe conditions that exposed Mr. Allen to the COVID-19 virus, before finally releasing Mr. Allen and issuing him two summonses charging Mr. Allen with disorderly conduct. Description: On November 8, 2012, Plaintiff stopped at a gas station to fill his car’s tank with gasoline. It was just after Hurricane Sandy, there was a gas shortage, and there were six lines at the gas station. Plaintiff, a full-time employee of the United States Postal Service, was dressed in his uniform. Responding to a question from Plaintiff, PO John Doe No. 1, who was assigned to monitor the crowds, told Plaintiff, in sum and substance, “You’re Postal; you can pull in line right there,” meaning the first responder’s line.
