Officers Morales and Uske ordered Plaintiffs to get on the floor and put their hands behind their backs. While Plaintiff Lynch was on the floor, Officer Morales kicked him in the side, causing him extreme pain. Description: Plaintiff was charged with attempted robbery in the 1st deg, crim sale of a controlled substance in the 3rd deg, and other charges. Plaintiff was accused to selling a controlled substance to an undercover police officer and then attempting to rob the same undercover officer. Police officers then approached the scene and plaintiff immediately put his hands up when officers punched his stomach, kicked him in the head and face two times. Allegedly, Officer Morales was subject to an NYPD disciplinary proceeding as a result of the incident.

Description: On October 29, 2014, plaintiff was inside a bodega in Brooklyn. Outside, an undercover NYPD officer was conducting a “buy and bust” operation. The officer had told his field team to arrest a man wearing a red shirt outside the bodega. As plaintiff walked outside, he was detained and arrested by the field team, which included Sgt. Eric Francis, Dt. Robert Hines, Dt. Steve Lafortune, Dt. Brian Martin, Dt. John McHugh, Dt Yolk Morales, Dt. Hugo Ortega, and Dt. James Walsh. Plaintiff was not wearing a red shirt. After his attack, Plaintiff required medical treatment for an asthma attack. Plaintiff was charged with criminal sale of a controlled substance. All charges were dismissed.
