Complaint
Description: On the evening of May 1, 2017, plaintiff, an African American male, was visiting a friend who lived on the 17th floor of a building in NYCHA's Castle Hill Development. While departing to head home, plaintiff and his friend were waiting at the elevator when defendant NYPS officers Del Carmen and Gengo. The arrest was initiated on the basis of plaintiff's perceived race. Defendant Del Carmen falsely claimed to have an arrest warrant for plaintiff, and, in effecting arrest, violently forced him to the ground. He was arrested on charges of public consumption of an alcoholic beverage, despite plaintiff not having been in possession of any such beverage or an open container of same.
