Description: On August 11, 2019, Plaintiff was lawfully present at Coffey Park, located at 85 Richard Street, Brooklyn when he was approached by Defendant Officers Schmalix and John Does, and subjected to assault and battery without probable cause consisting of being pushed and thrown to the ground, beaten and being forcefully handcuffed. Plaintiff was unlawfully arrested and transported to the 76th Precinct, where he was unlawfully imprisoned. Plaintiff was later taken to the Red Hook Community Justice Center, where he was held overnight and remained until released on August 12, 2019.

Description: On December 11, 2018, at approximately 1:00 a.m., Plaintiff was inside a vehicle at Lorraine Street and Smith Street in Brooklyn, New York. Plaintiff was unlawfully searched, handcuffed, arrested, and imprisoned by New York City Police Officers, including Officers Matthew Schmalix and Edwin Cesario. Plaintiff did not commit any crime, but Plaintiff was arrested without probable cause and transported to the 76th Precinct. After approximately 20 hours in custody, Plaintiff was arraigned on false charges of criminal possession of a weapon, and bail was set at $5,000. Plaintiff was then detained at Rikers Island for three days until all charges were dismissed on December 14, 2018.
