Description: On March 22, 2013, May 22, 2013, June 22, 2013, October 23, 2013, October 25, 2013 (2 separate occasions), and November 9, 2013, Plaintiffs were unlawfully stopped and searched by officers. On these separate occasions, Plaintiffs were either driving, walking, standing next to a parked vehicle, or at a deli lawfully when stopped. In each incident, Plaintiffs were forcibly patted down and had their vehicles searched when vehicles were involved. The officers offered either no explanation or false excuse as to why Plaintiffs were stopped. Description: The plaintiff was walking on the sidewalk when he saw 3 officers questioning a man on the ground. He decided to film the encounter and was approached by Officer Bejac who told the plaintiff that he was in the way of pedestrian traffic and to back up. The plaintiff complied, but continued filming and refused to present identification. The officers arrested the plaintiff for obstructing governmental administration, disorderly conduct, and resisting arrest. A jury trial occurred July 7-9, 2015, before Justice Gilbert Hong. The jury returned a not-guilty verdict on all counts.
