Description: On or about February 28, 2013, Plaintiff was a lawful patron within a retail store, shopping for a designer handbag while she was being monitored by Sergeant Erica Triebel, Officer Brian Kusterer, and two unnamed officers. Plaintiff purchased the designer bag and was physically accosted by the four officers at the subway station. Thereafter, Plaintiff was detained, questioned and interrogated by the officers against her will and without her consent or permission. The officers interrogated Plaintiff with specific information about her purchase obtained from their cooperation with the retail store. Plaintiff was suspected because of her racial identity.
