Description: Plaintiff was with his sister when he was approached by defendant officer De La Rosa within a movie theater. The off-duty officer had instructed the plaintiff to "tone it down". The plaintiff, who has been found to be legally "disabled due to a mental condition" and is blind in one eye, left the movie theater voluntarily. Defendant Officer De la Rosa followed the plaintiff and activated the NYPD Emergency Service Unit. When plaintiff left the theater, he was met with fifteen officers. Defendant officers assaulted plaintiff. They arrested and handcuffed him and sent him to the 44th precinct. He was later hospitalized. Description: On June 2, 2011 Plaintiff Freddie Charles was exiting a bodega near E 167th St and Clay Ave in the Bronx when he was shoved from behind by one of the defendant officers. Plaintiff was then immediately put in handcuffs that were excessively tight and transported to the precinct. No officers responded to his requests to loosen the handcuffs. Defendant officers, including officer Maria Brito, then falsified reports of disorderly conduct, obstruction of governmental administration and resisting arrest which the DA declined to prosecute. Plaintiff was held in custody for over 30 hours.
