Complaint
Description: On February 12, 2024, in the vicinity of the Midtown Precinct South, the defendants, NYPD officers John Kiernan, Thomas Donovan, and "John and Jane Does 1-10," falsely arrested, unlawfully imprisoned, and illegally searched and seized the plaintiff, who had not committed any crime or violation of the law. The officers affixed handcuffs to the plaintiff's wrists, and after the plaintiff's arrest, they intentionally made false statements and allegations against the plaintiff, who was charged with crimes that the plaintiff did not commit. Once the officers transported the plaintiff to a precinct, they subjected him to photographs, fingerprinting, and two strip searches.

Description: On or about March 7, 2018 at approximately 8:00 p.m. Plaintiff was on 42nd Street when PO John Kiernan assaulted, accosted, battered, arrested, confined, unduly restrained, and falsely arrested Plaintiff, who later learned he was being arrested for alleged grand larceny from Urban Outfitters and Sephora. Plaintiff was falsely imprisoned Plaintiff in a precinct then detention center for approximately 7 days. Plaintiff was maliciously prosecuted and all charges were ultimately dismissed on June 5, 2018. As a result of this incident Plaintiff suffered and continues to suffer severe mental anguish, humiliation, shame, and emotional distress.

Description: On March 25,2014 at approximately 10:57 a.m., Plaintiff was walking out of a store at 464 9th Avenue, New York, NY, with a bag that he had found on a bench when Defendants Palam, Kierman, and Zeufle arrested Plaintiff. Defendants Palam, Kierman, and Zeufle got on top of Plaintiff, was handcuffed while on the ground, and during the course of the handcuffing twisted his arm with great and excessive and needless physical force, with the result that the defendants caused plaintiff to sustain a severe right shoulder injury, consisting of a rotator cuff tear, and tear of his infraspinarus tendon and other personal injuries to other parts of his body.
