Description: Plaintiff told defendant Captain Roberts that he was afraid of being assaulted in Housing Unit 7B and subsequently asked to be housed somewhere else. Against the plaintiff's wishes, defendant Roberts transferred the plaintiff to Housing Unit 7B on February 21, 2016. Shortly after, the plaintiff was attacked where he was bleeding and calling for help while receiving no help from correction officers. Description: On June 2, 2011, at approximately 9:00 a.m., plaintiff was wrongfully arrested without probable cause by NYPD Officers Sergeant Edward Taveras, Police Officer Carlos Marchena, and other officers at his residence in the Bronx. During his arrest, plaintiff was physically assaulted with a riot shield, grabbed by the neck, thrown to the ground, and subsequently stomped, punched, and kicked by the officers, resulting in bruises and lacerations to his face, head, and torso. He was wrongfully accused and imprisoned for over 24 hours on charges of Resisting Arrest and other charges, leading to several court appearances. On October 20, 2011, all charges against plaintiff were adjourned in contemplation of dismissal.
