Description: On January 1, 2021, Plaintiff was lawfully present on the sidewalk when Officer Haroldy Cabreja and other Officers approached Plaintiff and without saying anything to Plaintiff assaulted and battered him. The Officers threw Plaintiff to the ground and punched him, then twisted his arms and applied tight handcuffs which caused further pain. The Officers then searched Plaintiff before removing him to the precinct, where Plaintiff was, among other things, subjected to a cavity search and interrogated without counsel. Defendant Officers then knowingly fabricated false information in order to prosecute Plaintiff, which caused Plaintiff to be arraigned in criminal court.

Description: On February 12, 2018, at approximately 4:00 p.m., Nathaniel Vargas was stopped near 1997 Hughes Avenue in the Bronx by NYPD Officer Haroldy Cabreja and other officers (referred to as John Doe and John Roe). Despite having no probable cause or legal justification, the officers searched, handcuffed, and arrested Mr. Vargas, allegedly based on fabricated evidence. During his detention, Mr. Vargas was subjected to excessive force, including a strip search. He was held for over 24 hours, made multiple court appearances, and was eventually cleared of all charges. Mr. Vargas sustained physical and emotional injuries due to the officers' actions and alleged misconduct under the NYPD's "Stop and Frisk" program.
