Description: On September 19, 2019, Plaintiff was lawfully on the street when approached by P.O.s including Officer Kelvin Guillen and Officer Nicholas Santomero. With no arrest warrant or probable cause, P.O.s stopped, searched, grabbed, assaulted, battered, and detained Plaintiff. Plaintiff was subjected to a strip search and was incarcerated for over 24 hours. During the arrest and detainment, Plaintiff sustained injuries as a result of assault and battery by P.O.s to his head, neck, back, body and limbs. All charges against Plaintiff were eventually terminated.

Description: On July 3, 2017, at approximately 3:00 p.m., near 646 East 220 Street, Bronx, New York, Plaintiff was outside their residence, speaking with a friend. While nearby, a 2006 black BMW was parked, though Plaintiff had neither used nor touched the vehicle. Police Officer Kelvin Guillen and other unnamed officers (John Does) approached Plaintiff, forcefully grabbed them, threw them to the ground, scraped their face on the ground, and applied pressure to Plaintiff’s ribs and back, causing substantial pain. Plaintiff was then handcuffed and arrested without probable cause.
