Defendant Officer Pichardo pointed her gun at him and he went back to his apartment with the door open. Defendant officers grabbed him, took his phone, tightly handcuffed him, and searched his apartment. Plaintiff was taken to Housing PSA 1, then the 60th Precinct and was charged with various crimes including assaulting a police officer, which the DA declined to prosecute.
