Description: On May 20, 2006, Plaintiff was approached by police officers Richard Collins, David Teta, Eric Cabrera, Alvarez, Jessica Alvarado, and Sergeant Brian Stamm. Without a warrant or legal basis, the officers seized, detained, and handcuffed Plaintiff. Officers violently grabbed Plaintiff and struck his head against a wall. The force lacked legal justification and it was not reasonable for the officers to believe such force was necessary. Plaintiff was searched at the time of his arrest. No contraband of any sort was recovered from or possessed by Plaintiff. Nevertheless, he was taken to the precinct where he was kept in custody.
