Description: On March 2, 2020, Plaintiff Tracy McCarter was visited at her Manhattan residence by her estranged and abusive husband, James Murray. Mr. Murray had an extensive history of alcoholism and domestic violence toward Plaintiff. Plaintiff returned from work to find Mr. Murray waiting for her outside her apartment, at which point she allowed him inside to retrieve his medications and sleep on the couch. Once inside, Mr. Murray became combative towards Plaintiff. Mr. Murray pushed Plaintiff into a mirror and choked her. Description: On or about June 6th, 2017, Plaintiff was approached by DET Alexander Cruz, PO "John Doe" and PO "Jane Doe" of the NYPD. Plaintiff was subdued with excessive force by the officers, sustaining a black eye and other injuries. Plaintiff was arrested and charged with robbery and grand larceny relating to an incident that had occurred on June 5th. Plaintiff was never identified by any witness and did not have any proceeds from the robbery on his person. He vehemently denied the charges. DET Cruz and PO's falsely and maliciously instigated the commencement of criminal proceedings against Plaintiff. Plaintiff was incarcerated for 1 year and 6 months. Plaintiff was acquitted after a trial on October 11th, 2019.
