Description: On October 27, 2013, Plaintiff was selling his artwork on a public sidewalk in Manhattan. Plaintiff was in compliance with applicable regulations governing sidewalk vending. Defendant Officer Smiley saw the Plaintiff's display and when Plaintiff could not produce a vending license, Defendant Officer arrested him. A license was not necessary to engage in the conduct Plaintiff was engaged in. After numerous court appearances a not guilty verdict was entered and the case was dismissed.
