Description: On March 27, 2013, Plaintiff was on the streets when he was physically stopped and battered by Defendant NYPD police officers including PO J. Simicich, PO Gebhart. As a result of being battered, Plaintiff suffered comminuted fractures, a non displaced fracture, and other injuries. Plaintiff was arrested and placed inside of a police car, after which a complainant identified Plaintiff as a person who used a firearm to rob her of $600. Plaintiff was later detained on a Robbery charge. On or about May 31, 2013, the pending charges were dismissed by a Grand Jury.
