Description: On July 31, 2018, at approximately 5:50 p.m., plaintiff Edward Koehl was driving a friend's 2007 Chevrolet van when he was pulled over by New York City Police Officers Pascone (Shield #965400), Meshel (Shield #975855), and Maglio (Shield #949735) near the intersection of Huguenot Avenue and Amboy Road. Officer Pascone alleged that Koehl was using a cell phone while driving. However, Koehl showed that he was holding a small battery-operated light, not a cell phone. Despite this, Pascone and Meshel issued a traffic ticket for cell phone use. While Koehl was questioning the reason for the ticket, Officer Maglio opened the van’s passenger door without consent, warrant, or probable cause and began searching the veh...
